Terms and Conditions

Seaside Plumbing Inc., hereinafter referred to as ‘Company’.

All proposed services may not be the only options available to the customer. Proposed service prices are good at the time of this visit only & subject to change without notice. If, for any reason, the person authorizing the work and/or service does not wish to go any further or if the work is not completed, payment for any service and/or materials already expended is due immediately. Any subsequent work will then be charged additionally.

Payments are to be made by cash, check, Visa, MasterCard, Discover or Amex to the Company’s representative at the signing of the work authorization, or immediately upon completion of work. There is a minimum $20 fee for returned checks. Invoices over 60 days will begin to accrue 1.5% monthly interest.  Should the Company be required to engage the services of a collection agency or attorney to collect the sums due, the owner agrees to pay all costs of collection, court costs & reasonable attorney’s fees.

All labor & material is conclusively accepted as satisfactory unless stated otherwise in writing within 7 days of job completion.  Any claim for property damage is conclusively waived unless presented to the Company in writing within 7 days of the occurrence.

The liability of the Company for malfeasance or non-performance is limited to the amounts due hereunder.

Regular business hours are Monday-Friday, 8:00 am to 4:30 pm, excluding holidays. Special business hours are any hours other than regular business hours. Prices charged during special business hours are higher than prices charged during regular business hours.

REGARDING CONDITIONS WHICH ARISE AFTER COMMENCEMENT OF WORK:

I am aware & agree that due to the nature of the work which I have requested, circumstances other than those described in the agreement may arise after work has begun; I accept full financial responsibility for these circumstances &, I accept & understand that I am still obligated to the Company for that to which I have agreed before the circumstance(s) arose; & I hold the Company, its heirs & assigns harmless regarding this matter.

FAUCETS DECLINED TO BE REPLACED:

I have decided not to have my faucet replaced. I am aware, agree & accept that faucet repairs & attempts to repair are not guaranteed and/or warranted in any way by the Company. I have chosen to have the Company check the condition of my faucet for an agreed fee & I understand that in checking the faucet, they may not be able to reassemble or repair it. I understand that faucet repairs & replacements will be charged to me at an additional cost beyond the fee to inspect the faucet. If, for any reason, the faucet is not repaired, I take full responsibility, including the cost of repairs. I will pay the company for their service as agreed & I hold the company, its heirs & assigns harmless regarding this matter.

SEWER & DRAIN CLOGS:

I am aware, agree & accept that any attempts to clear a sewer or drain clog are attempts only & are not guaranteed and/or warranted in any way by the Company. I take full responsibility, including the cost of repairs. I will pay the Company for their service as agreed & I hold the Company, its heirs & assigns harmless regarding this matter.

WATER PRESSURE REGULATORS & RELIEF VALVES ON BOILERS & WATER HEATERS:

I am aware, agree & accept that when service is performed on my heating system or domestic water heating system, water pressure regulators & relief valves may be found to not function properly. I accept all responsibility for these items including cost of repairs & I hold the Company, its heirs & assigns harmless regarding this matter.

CUSTOMER SUPPLIED MATERIAL:

I am aware, agree & accept that customer supplied material is not guaranteed and/or warranted in any way by the Company. If for any reason customer supplied material is defective in any way, the agreed price for the installation is due immediately. Any other work/service will be charged to the customer additionally & payable immediately. I hold the Company, its heirs & assigns harmless regarding this matter.

WALL, CEILING & FLOOR OPENINGS:

I am aware, agree & accept that more than one opening may be needed & that each opening represents an additional cost to me. The Company is not responsible for drywall repairs, an access panel will be installed when possible. I hold the Company, its heirs & assigns harmless regarding this matter.

WATER HEATER / SCALDING / RELIEF VALVE NOTIFICATIONS (TO BE SIGNED BEFORE REPLACEMENT WORK):

I am aware that all water heaters will eventually leak & may cause damage & I accept full responsibility for any damage. Further, I hold the Company, its heirs & assigns blameless for any damage caused by said leakage. I am aware that water temperature of a water heater should not exceed 120 degrees F & that the Company will not set the water temperature above 120 degrees F. Therefore, I am aware that I may need a larger water heater than I have chosen & I accept full responsibility for my choice.

THERMOSTATIC MIXING VALVES:

If a thermostatic  mixing valve is installed, I understand that it needs to be serviced annually by a certified technician. I hold The Company harmless of any failure of a thermostatic mixing valve due to non-servicing.

OUTDOOR ITEMS & WINTERIZATIONS:

I understand that any outdoor plumbing items are subject to the weather & elements. I understand that these outdoor items must be winterized properly before the risk of freezing weather. Winterization of these items can be completed by the Company for an additional cost, but it is my responsibility to request this service from the Company. There are no guarantees and/or warranties on any outdoor items.

APPLIANCES & EQUIPMENT DIAGNOSIS:

I am aware & agree that my appliance/equipment which I have requested to be checked out and/or serviced may not be repairable. I will pay the Company the agreed fee for checking the unit & hold the Company harmless regarding this request including any damage which may be done to the appliance/equipment as a result of conventional diagnostic and/or repair efforts.
